However, when legal action is necessary, we are able to proceed quickly and efficiently, alleviating the need for you to go through a middle-man. We have a full time collections staff that is knowledgeable and experienced in bringing our clients’ claims to a productive and profitable disposition. In all, we make the collection process hassle-free. In addition, we use these and other readily available resources to track down hard-to-find debtors at little or no cost to you.
Once an account is placed with Rembish, LaSaracina & Bizzarro, we take the following steps:*
· Claim is reviewed and we use our various resources to locate the debtor
· Send demand letter
· Three (3) days after demand letter is sent, we follow up with a phone call
· Seven (7) days after the demand letter is sent, if we are unable to communicate with the debtor, we file a complaint
o Small Claims – On debts of $5,000.00 or less, we will file a small claims complaint. The cost to file said complaint is $35.00, which is recoupable from the debtor following a judgment.
o Superior Court – On debts of more than $5,000.00, we will file a superior court complaint. The cost to file said complaint is $225.00, plus you have to pay a state marshal anywhere from $45 - $70 to serve the complaint. Again, these costs are recoupable from the debtor following a judgment.
· After we obtain a judgment:
- File a Judgment Lien: If the judgment debtor owns real estate we will place a judgment lien on the property. The cost is $43, but again that too is recoupable from the judgment debtor
- Send Interrogatories – Sometimes we send interrogatories to the debtor and local banks, but that is only if we have a very strong feeling of where the debtor has a bank account.
- Executions
i. Bank Executions – We work closely with our network of state marshals who regularly visit banking institutions to seek and verify the debtors’ accounts.
ii. Wage Executions – If we are able to determine where the judgment debtor works, we will file for a wage execution. The cost is $35 and that is recoupable from the judgment debtor. The judgment debtor’s employer would then be required to pay a certain portion of her check to us until the judgment is satisfied.
o Examination of Judgment Debtor – If we can’t collect using any of the aforementioned methods, we cause the judgment debtor to be brought into court and questioned under oath as to what assets they have. If the judgment debtor fails to appear in court, we will order a capias and have a marshal find the judgment debtor and physically bring them into court to answer our questions.

In addition, time frames during the litigation process are purposefully omitted because each case may be handled differently.
